Terms of Service

1. The service

Traack lets you log meals and ingredients, track calories, nutrients, weight and activity, see your trends, and optionally use AI features and social features such as profiles, comments, follows and the Discover feed. We may add, change or remove features, and will tell you in advance about changes that materially reduce what you paid for.

2. Eligibility

You must be at least 16 years old and able to form a binding contract. If you are under 18, you confirm that your parent or guardian agrees to these terms. You may not use Traack if you are located in a country subject to comprehensive United States sanctions, are on a United States government list of restricted parties, or are otherwise barred from using it by law.

3. Health disclaimer

Traack is a general wellness and tracking tool. It is not a medical device and does not provide medical, dietetic or nutritional advice, diagnosis or treatment. Calorie, nutrient and AI figures are estimates and can be wrong. Talk to a doctor or registered dietitian before changing your diet, weight or exercise, especially if you are pregnant or breastfeeding, are under 18, have or have had an eating disorder, or have a medical condition. Stop tracking and seek help if it makes your relationship with food worse. In an emergency, call your local emergency number.

4. Your account

• Keep your login details secure. You are responsible for the activity under your account.
• Give accurate information and keep it up to date. One account per person.
• You can sign in with email and password, Google or Apple.
• Tell us promptly at support@traack.app if you believe someone accessed your account without permission.

5. Privacy and your data

Our Privacy Policy and Consumer Health Data Privacy Policy explain how we handle your data, including the health data you log, which we only process with your explicit consent. Your meals are private unless you turn on meal sharing, and AI features stay off until you allow them.

6. Your content

• You keep ownership of what you create: meals, photos, comments and other entries.
• You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content, only as needed to provide Traack to you and, for content you share, to show it to the people you share it with. The licence ends when you delete the content or your account, except for copies we must keep by law.
• You are responsible for your content and confirm that you have the rights to post it. If you send us feedback, we may use it without any obligation to you.

7. Community rules

Do not use Traack to post or do anything that:

• is illegal, or infringes anyone's copyright, trademark, privacy or other rights;
• sexualises minors or shows child sexual abuse (we report it to the authorities);
• shares intimate images of anyone without their consent;
• is sexual, violent, hateful, harassing, bullying or threatening, or body-shames others;
• promotes eating disorders, extreme restriction, purging or self-harm;
• is spam or a scam, is misleading, or impersonates someone;
• shares another person's personal data without their permission;
• tries to access other users' data or accounts, interferes with our security or systems, scrapes the service, or reverse engineers the apps except where the law allows it;
• misuses the AI features, including trying to make them produce harmful content or to get around credit limits.

8. Moderation, reports and appeals

Anyone can report content or accounts in the app or as described on our Copyright and Content Reports page. People review reports; we do not remove content automatically. When content breaks these terms or the law, we may remove it, limit who can see it, warn you, or suspend or close your account, in proportion to how serious and frequent the breach is. We tell you what we did and why, unless the law or someone's safety prevents it, and you can ask us to review the decision by replying or writing to support@traack.app. In appropriate circumstances we close the accounts of repeat copyright infringers.

9. AI features

• AI features are optional and only work after you allow AI processing in the app. They run on OpenAI's models, as described in our Privacy Policy.
• AI replies are generated automatically, are marked as AI in the app, and can be inaccurate, incomplete or out of date. Check them before relying on them; they are not professional advice.
• Do not enter other people's personal data. You are responsible for how you use AI output.
• AI features use credits. The price of each request (message, photos and completed web searches) is shown in the model selector before you send it, and the final charge appears with the answer.
• Replies to @ai in comments are only available on your own meals.

9.1. Live Coach calls

• Live calls are optional Pro features and require AI consent, microphone permission and acceptance of the call prices and conditions before each connection. The selected voice is fixed for that call.
• The call screen shows the voice model, credits per minute, minimum voice charge and token rates for the backend model before you start. There is no flat price per call: the charge combines actual voice duration and completed backend model usage. The current GPT-Live voice catalog is 15 credits per minute, with a 15-second minimum (3.75 credits) included in the duration. All currently offered voices share that rate. Data lookups use the fast Coach model at the displayed token rates, with a 0.5-credit minimum per lookup; they are additional to voice time. Future models or prices may differ; review the current screen. The quoted versions apply throughout that call.
• Voice is metered by the second; silence, muted time and waiting for backend work count. Starting a connection can incur the minimum even if you end it quickly. Once usage has occurred, ending a call, a network failure or an unsuccessful lookup does not erase consumed voice or completed backend model usage.
• Choose a maximum credit budget before each call. We reserve available credits up to that limit and require the displayed minimum balance; requests cannot start below it. The time limit depends on the reserved budget and rate, is never more than eight minutes, and may shorten as lookups consume credits. The server ends calls before the budget is exhausted and after inactivity; continuing requires a new connection and acceptance. Pro does not include unlimited calls.
• Unused reserved credits return to their original balance after the server confirms final provider usage. You are charged only once. If creation or closing is uncertain, the hold remains pending for recovery or reconciliation instead of a guessed refund. The app displays pending settlement; contact support if it does not resolve.
• Your audio is sent to OpenAI, together with the transcript and the private records required by your request. Traack stores the transcript, results and billing history in your private account, not the raw call audio. Calls end when you leave the screen, background the app or lose Pro or AI consent. AI output may be wrong and is general wellness information, not medical advice. Destructive actions require the confirmation card in the app; a spoken yes does not execute them.

10. Pro plan and payments

• Traack Pro is a monthly or yearly subscription that removes the free plan's limits and includes AI features with a recurring allowance of credits. The current price, billing period and what is included are shown before you pay.
• Subscriptions renew automatically at the end of each period at the then-current price until you cancel. You can cancel at any time; you keep Pro until the end of the period you paid for and are not charged again.
• On our website, Stripe processes payments and you cancel in Settings > Subscription. In the iOS and Android apps, Apple or Google process the purchase under their own terms, and you manage or cancel it in your App Store or Google Play subscription settings. Deleting your Traack account does not cancel a store subscription.
• If we change the price of your subscription, we tell you in advance and the new price applies from your next billing period. You can cancel before it applies.
• Prices may be shown in your local currency. Taxes are included or added as shown at checkout.

11. Credits

Credits are the unit Traack's AI features use. Each Pro plan includes a recurring allowance of credits and, if you need more, you can buy additional one-time credit packs. The current prices and amounts are always shown at checkout; for reference, these are the current costs and allowances:

• Chat costs: check the model selector for message, image and Web Search rates. The server returns the final breakdown, which is kept in history at the rate charged. Diet and metrics suggestions retain their separate rate displayed in the app.
• For text requests, enough balance is required for the indicated maximum number of searches and that amount is temporarily reserved. On completion, actual usage is charged up to the quoted maximum and the remainder is released. Incomplete search attempts add no charge. If a request fails before it is completed and charged, its reservation is released without a charge.
• Pro Monthly ($2.99/month): includes 100 AI credits every month.
• Pro Yearly ($24.99/year): includes 1,300 AI credits per year, which works out to one extra month free compared with the monthly plan.
• Additional credit packs (one-time purchase): 100 credits ($1.99), 400 credits ($6.99), or 1,000 credits ($9.99).
• Credits included with your plan refresh at the start of each billing period. Credits have no cash value and cannot be exchanged or transferred. AI features can only be used with an active Pro plan.
• Credits end when your account is deleted. Credits we give as rewards or promotions may have additional conditions shown when you receive them.

12. Plan limits

The free plan lets you use Traack with some limits; the Pro plan removes those limits and unlocks the AI features. The current limits are:

• Free plan: up to 20 saved ingredients, up to 5 pre-saved meals, and up to 3 months of macro history and trends. The free plan does not include AI features or credits.
• Pro plan: unlimited ingredients and pre-saved meals, full macro history and trends, AI suggestions for your objectives, and your plan's AI credit allowance (see section 11).

13. Right of withdrawal (EU and UK consumers)

• If you are a consumer in the EU or the UK and buy on our website, you can withdraw from a subscription within 14 days of purchase without giving a reason.
• Pro starts immediately at your request, so if you withdraw you only pay for the days you used; we refund the rest within 14 days of receiving your withdrawal.
• Credits are delivered immediately at your request, and before paying you acknowledge that the legal right of withdrawal ends once they are delivered. Even so, if you change your mind within 14 days of buying, we refund the credits you have not used.
• To withdraw, use Withdraw from contract here in Settings, on our website or in the app, during the withdrawal period, or email support@traack.app with your name, your account email and the purchase you are withdrawing from. We confirm receipt by email.
• For purchases made through the App Store or Google Play, ask Apple or Google for a refund under their policies.

14. Refunds

Apart from the right of withdrawal and other rights the law gives you, payments are non-refundable and we do not refund partial periods after you cancel. Nothing in these terms limits your statutory rights.

15. Third-party services

Traack works with services from Google (Firebase, Google Sign-In, Health Connect), Apple (Sign in with Apple, Apple Health, the App Store), OpenAI and Stripe. Your use of them may also be subject to their own terms. We are not responsible for services we do not control.

16. Our intellectual property

Traack's software, design and brand belong to us. We give you a personal, non-exclusive, non-transferable and revocable licence to use the apps and website for your own non-commercial use under these terms. You may not copy, sell or create derivative works of Traack, or use our name or logos, without our permission.

17. Suspension and termination

You can stop using Traack and delete your account at any time in Settings. We may suspend or end your access if you seriously or repeatedly breach these terms, if the law requires it, or if we stop providing Traack; in that last case we will give reasonable notice where we can and refund any prepaid period we cannot provide. Terms that by their nature should survive termination continue to apply.

18. Disclaimers

To the extent the law allows, Traack is provided "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that Traack will be uninterrupted or error-free, or that any figure, estimate or AI output is accurate. If you are a consumer in the EU or the UK, you keep your statutory rights for digital content and services that are not as described.

19. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, and our total liability for any claim relating to Traack is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars. None of this limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law, including your mandatory rights as a consumer.

20. Indemnity

To the extent the law allows, you will compensate us for claims by third parties that arise from content you post or from your breach of these terms. This does not apply to consumers where local law prohibits it.

21. Governing law and disputes

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring claims before your local courts. Otherwise, disputes go to the state or federal courts located in Miami-Dade County, Florida. Before starting a claim, please contact support@traack.app so we can try to resolve it informally within 30 days.

22. Apple App Store

• If you downloaded Traack from the Apple App Store, these terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content.
• Your licence is limited to using the app on Apple-branded devices you own or control, as allowed by the App Store's usage rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app does not conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app does not comply with a legal or regulatory requirement, consumer protection or privacy claims, or claims that the app infringes a third party's intellectual property.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

23. Changes to these terms

We may update these terms. For material changes we give you notice in the app or by email before they take effect and ask you to accept them. If you do not agree, you can delete your account, and if a change materially affects a subscription you paid in advance and you cancel for that reason, we refund the unused part.

24. General

• These terms, together with the policies they refer to, are the entire agreement between you and us about Traack.
• If any part of them is found invalid, the rest remains in force. Not enforcing a right is not a waiver of it.
• We may transfer our rights and obligations under these terms as part of a merger or sale of our business, without reducing your rights. You may not transfer yours.
• These terms are available in English and Spanish, and both versions have the same effect.
